Wisconsin’s own overtime law
Wisconsin has an overtime law of its own that reaches most employers: time and one-half the regular rate for every hour over 40 in the workweek. Its exemptions are not identical to the FLSA’s — agricultural employees, taxi drivers, movie theater employees, and salespeople, parts staff and mechanics at motor vehicle dealers are all excluded, as are most non-profit organizations, though not when they run restaurants or hotels.
The AB 461 veto
Assembly Bill 461 would have adopted, for Wisconsin income tax, the federal deduction for qualified overtime compensation. The Legislature passed it in 2026 and the Governor vetoed it in its entirety. Overtime therefore remains fully taxable in Wisconsin.
