2025 Public Act 24

Signed October 7, 2025, PA 24 amended MCL 206.30 so that, for tax years beginning after December 31, 2025 and before January 1, 2029, taxpayers deduct the qualified overtime compensation they deduct federally under IRC § 225 (nonresidents only for Michigan-sourced work). Treasury’s January 2026 notice says the Michigan deduction “should generally mirror” the federal one. The 2025 tax year gets nothing.

The Wage and Hour Division accepts complaints online. A claim for unpaid wages or fringe benefits must be filed within 12 months of the violation, but minimum wage and overtime complaints can be filed up to 3 years afterwards.

A minimum wage in transition

Michigan’s rate rose slowly — $8.50 in 2016, $9.65 in 2020, $10.33 in 2024 — before a larger step to $13.73 in 2026. The scheduled $15.00 takes effect January 1, 2027; from 2028 it is adjusted for inflation. The state law steps aside for FLSA-covered work only when the state rate is lower than the federal one.
