Rates and deadlines

Illinois runs a separate youth rate — $13.00 for workers under 18 who work fewer than 650 hours a year — and a $9.00 cash wage for tipped employees, while overtime under the Minimum Wage Law is owed after 40 hours at time and one-half the regular rate. The Department also licenses sub-minimum rates for learners and some workers with disabilities, a program being phased out for sheltered workshops.

The Illinois Department of Labor’s wage claims division says a complaint must be filed within one year after the wages or final compensation were due, and it limits its own investigation to the three years before the complaint.

From $8.25 to $15.00

Illinois sat at $8.25 from 2010 until 2019. It then stepped up each year — $10.00 in 2020, $12.00 in 2022, $14.00 in 2024 — to $15.00 in 2025, where it now stays.

No state relief on the deduction

The IL-1040 starts from federal adjusted gross income, and the 2025 instructions contain no overtime subtraction, so the federal deduction reduces only your federal tax.
