South Dakota Overtime Calculator
South Dakota sets a voter-indexed minimum wage — $11.85 in 2026 — but has no overtime statute, so time and a half after 40 hours comes from the FLSA. There is no income tax.

South Dakota has no income tax on wages — overtime is untaxed by the state.
An indexed wage, announced each October
The Department of Labor & Regulation announces the next year’s rate by October 15, and the law says the minimum wage cannot decrease. It was $8.55 in 2016, $9.30 in 2020 and $11.20 in 2024; tipped employees receive half the full rate in cash wages, $5.925 an hour in 2026. Until the 2027 figure is posted, the calculator asks you for it from January 1.
The increase follows the Consumer Price Index and is rounded up to the nearest 5 cents. Seasonal amusement or recreation establishments, babysitters and outside salespeople are exempt from the state minimum wage (SDCL 60-11-3 and 60-11-3.1), and a training wage is allowed under SDCL 60-11-4.1.
Federal routes for overtime problems
South Dakota’s wage-and-hour page directs FLSA and FMLA complaints to the U.S. Department of Labor and links its Workers Owed Wages portal for back pay already recovered by federal investigators.
