Nebraska Overtime Calculator
Nebraska has no overtime statute, so the FLSA’s 40-hour rule applies, but voters have pushed its minimum wage to $15.00. An attempt to add a Nebraska overtime tax adjustment was indefinitely postponed in April 2026.

Your no-tax-on-overtime deduction
Nebraska (2026): taxes all overtime — no state deduction.
From $9.00 to $15.00
The state minimum stayed at $9.00 from 2016 to 2022, then rose to $12.00 in 2024 and $15.00 in 2026. From January 1, 2027 it is adjusted for the cost of living; the 2027 figure was not posted when we checked, so the calculator asks for it. The law applies to employers of four or more employees.
LB 30 and the tax question
Nebraska starts from federal AGI. The Department of Revenue’s 60-day report on the 2025 federal law explained that the tips, overtime and car-loan deductions come after AGI and “will have no automatic impact on Nebraska individual income tax receipts.” LB 30 would have let workers subtract overtime from federal AGI; it was carried over into 2026 and indefinitely postponed on April 17, 2026.
Wage complaints
The Nebraska Department of Labor’s wage complaint form is for past-due or unpaid wages and disputes over payroll, unauthorized deductions and minimum wage. It is not the form for unemployment claims.
