K.S.A. 44-1204 and the 46-hour week
Since January 1, 1978, the Kansas Minimum Wage and Maximum Hours Law has required time and a half after 46 hours in a workweek. Subsection (c) says the section does not apply to anyone covered by section 7 of the FLSA. If your employer is genuinely outside federal coverage, switch on “Not covered by the FLSA” to apply the 46-hour threshold.
Subsection (b) gives public emergency medical service workers a work-period alternative: a period of up to 28 days, with overtime owed only when tours of duty exceed the same ratio as 258 hours to 28 days.
Wage Payment Act hearings
Unpaid wages are pursued under the Kansas Wage Payment Act (K.S.A. 44-313 and following). The Department of Labor’s Office of Employment Standards reviews the claim, and disputes go to a hearing; you then have 18 days to ask the Secretary to review the presiding officer’s order, and 30 days after the Secretary’s decision to seek judicial review.
Tax
Kansas income starts from federal AGI, so the federal overtime deduction never reaches the Kansas return. SB 311 would have excluded certain overtime; the Department’s summary of 2026 legislative changes contains no overtime provision.
