Rules that go beyond overtime

When the spread of your workday is more than 10 hours, or you work a split shift, New York requires one extra hour of pay at the minimum wage. Factories, mercantile establishments, hotels, restaurants and certain building workers must get 24 consecutive hours of rest each week; domestic workers who work on their rest day earn premium pay. None of these is overtime, and the calculator does not add them.

Why 2027 brings no raise

The Department of Labor explains that New York’s rates can rise with inflation each year, but the law contains “off-ramps” that block an automatic increase, and one of them was triggered for 2027. Rates stay at $17.00 in New York City, Long Island and Westchester and $16.00 in the rest of the state.

State tax

New York starts from federal AGI, which the federal overtime deduction does not touch. The Tax Department’s FY 2027 budget materials describe a new state deduction for tipped wages — and nothing comparable for overtime.
