Who the $15.00 floor leaves out
The state law covers almost everyone, but agricultural workers have a separate minimum of $8.00 an hour, and members of religious orders, certain trainees in educational, nonprofit or religious organizations and outside salespeople are excluded. Tipped service employees can be paid a $6.75 service rate when they receive more than $20 a month in tips.

The June 2026 Technical Information Release lists § 70202, “No tax on overtime,” as a provision the Commonwealth does not adopt. Overtime is taxed at the Massachusetts rate in full.
