Alaska is one of only four states that pays overtime by the day for ordinary jobs: past 8 hours in a workday or 40 in a workweek, at time and a half. Its minimum wage climbs a dollar a year under the 2024 ballot measure — $14.00 now, $15.00 on July 1, 2027.

AS 23.10.060, in practice

The statute counts the week without double-counting: hours already paid as daily overtime are left out when testing whether you passed 40. Four 12-hour shifts therefore produce 16 overtime hours in Alaska, against 8 under federal law.

Two carve-outs matter most. The overtime section does not apply to an employer with fewer than four employees in the regular course of business, and a voluntary flexible work hour plan approved by the Department of Labor can set 10-hour days with overtime only after 10. Workers handling, packing or processing agricultural and dairy products, and small seasonal mining operations, have their own exemptions in subsection (d).

Getting unpaid overtime back

Alaska’s Wage and Hour section is the sole enforcer of the state’s wage-payment, minimum wage and overtime laws. It takes wage claims on its own form and pursues employers through administrative, quasi-judicial and court procedures on the worker’s behalf.

Tax picture

There is no state income tax in Alaska, so the only tax lever on overtime is the federal deduction. Remember that the federal deduction ignores Alaska’s daily overtime: only the half-time premium for hours past 40 in the week qualifies.
