The $4,000 exemption and domestic workers

Hawaii’s wage and hour law exempts an employee guaranteed $4,000 or more a month, and since Act 248 of 2013 it covers domestic service workers for both minimum wage and overtime. The state law steps aside for FLSA-covered employment only when the federal rate is higher — which it no longer is.

The Wage Standards Division begins with a preliminary interview: a specialist decides which of the six laws it enforces applies, whether you are covered or exempt, and whether the complaint is timely. Only then are you given the complaint form to complete and sign.

A schedule set in statute

Hawaii moved from $8.50 in 2016 to $10.10 in 2018, $12.00 in 2022 and $14.00 in 2024, then $16.00 in 2026; the next and final step in the current law is $18.00 on January 1, 2028.

Act 35 and the overtime deduction

For 2025, Hawaii’s income tax conformed to the Internal Revenue Code only as of December 31, 2024 (Act 123), so the overtime deduction did not exist for Hawaii. Act 35 of 2026 moved conformity to December 31, 2025 but lists IRC § 225 among the provisions that are not operative in Hawaii for tax years after 2025.
