Virginia matched the federal $7.25 until 2020, reached $11.00 in 2022 and $12.00 by 2024, and has been adjusted since — $12.41 in 2025 and $12.77 in 2026. The Department of Labor and Industry says the rate rises to $13.75 on January 1, 2027.

Conformity, fixed
The thirteenth enactment clause of HB 29 (2026) replaced Virginia’s rolling conformity with a fixed Internal Revenue Code date of December 31, 2025. Virginia starts from federal AGI, so the overtime deduction does not reach the state return, and a 2026 Senate bill to subtract 25 percent of the federal amount (SB 143) does not appear among the enacted changes.
