North Carolina (2026): taxes all overtime — no state deduction.
The 45-hour seasonal rule
Seasonal amusement or recreational businesses in North Carolina owe premium pay only after 45 hours a week under state law. If the business is also covered by the FLSA without a federal exemption, the 40-hour federal rule still controls.
NCDOL complaints
The Wage and Hour Bureau takes complaints online, but it cannot investigate work performed outside North Carolina and accepts anonymous complaints only in limited situations. You may also sue in civil court without filing with the Department first.
Tax
North Carolina starts from federal AGI. Its July 2026 notice updated the Internal Revenue Code reference and added new state adjustments for research costs, timber losses and gambling losses — but no overtime deduction.
Example week
North Carolina’s median wage was $23.06 an hour; this is a 50-hour week at that rate.
