What the Georgia Department of Labor does — and doesn’t — handle
Georgia DOL tells workers that most workplace pay problems are resolved by federal agencies: the U.S. Department of Labor’s Wage and Hour Division enforces minimum wage, overtime and hours under the FLSA. The state wage law itself applies only to employers with six or more employees and excludes any employment the FLSA already covers.
HB 463’s $1,750 exclusion
Signed by Governor Kemp on May 11, 2026, HB 463 cut the income tax rate from 5.19% to 4.99% and added O.C.G.A. § 48-7-27(a)(16): for 2026 through 2028, qualified overtime compensation as defined in IRC § 225, up to $1,750, received by a full-time employee paid an hourly wage, is excluded from Georgia taxable net income. Salaried workers who are owed overtime and part-time hourly workers do not qualify under that wording.
For 2025 Georgia offered nothing: its return starts from federal adjusted gross income, which the federal overtime deduction does not reduce.
Railroad workers
The same paragraph has a special rule for employers governed by the federal Railway Labor Act: for them, the exclusion applies to “hourly component overtime compensation as defined in applicable collective bargaining agreements.”
