Amendment 2’s staircase

Voters amended Article X, § 24 in 2020 to raise the wage to $10.00 on September 30, 2021 and then $1.00 every September 30 until it reached $15.00 on September 30, 2026. From September 30, 2027, the state recalculates it for inflation each year. The DOL history table shows the effect: $8.05 in 2016, $10.00 in 2021, $12.00 in 2023.

No state agency for unpaid overtime

Florida has no state wage-hour department. Overtime claims go to the U.S. Department of Labor or to court. Minimum wage claims under Florida Statutes § 448.110 require written notice to the employer first; the employer has 15 days to pay, and the statute of limitations is tolled during that window. The Attorney General can fine willful violators $1,000 per violation.

Daily hours do not matter

With no daily rule, a nurse or hospitality worker on 12-hour shifts earns overtime only once the workweek passes 40 hours — unless the employer is a hospital or residential care facility using the alternative FLSA method the IRS overtime FAQs point to (DOL Fact Sheet #54).
