The 48- and 60-hour exceptions

Maryland’s Employment Standards Service explains that employees of bowling alleys and of non-hospital residential care institutions — certain nursing homes, assisted living facilities and group homes where residents live on site — are owed time and a half only after 48 hours a week under state law. Agricultural workers not otherwise exempt get it after 60 hours.

The same page warns that federal law may still require overtime after 40 for those employers. The calculator therefore applies the FLSA’s 40 hours.

County minimums and how to claim

Howard, Montgomery and Prince George’s counties set their own minimum wage laws on top of the state’s $15.00, which Maryland reached in 2024 after rising from $8.75 in 2016. To recover unpaid wages, you complete and sign the ESS claim form and send it to the Employment Standards Service before any investigation begins; a mailed copy can be requested at 410-767-2357.

Why the federal deduction stops at the state line

The Comptroller’s guidance concluded that the federal tips, car-loan, overtime and senior provisions do not change federal adjusted gross income and therefore do not change Maryland income. A 2026 bill to add a Maryland overtime subtraction for 2026–2028, HB 1035, did not pass.
