With no state statute, the U.S. Department of Labor’s Wage and Hour Division is the agency that investigates unpaid overtime in Louisiana. When it has already recovered back wages from an employer, workers claim their share through the Workers Owed Wages portal using the Back Wage Claim Form (WH-60).
The bill that stayed in committee
HB 194 of the 2025 regular session would have created a Louisiana deduction for overtime compensation for residents below certain income levels. It was referred to the House Ways and Means Committee and never reported out, so overtime remains fully taxable on the Louisiana return.
