Texas Minimum Wage Act
Texas adopts the federal $7.25 by reference and excludes any employment the FLSA covers, which is why a 12-hour shift is never overtime in Texas unless the week passes 40 hours. Because there is no state overtime statute, an overtime claim in Texas is an FLSA claim.
The Payday Law’s 180-day clock
Unpaid wages that are already earned — including overtime your employer agreed to pay — can be claimed through the Texas Workforce Commission under the Texas Payday Law. The claim must be filed within 180 days of the date the wages should have been paid, online or on paper, and decisions can be appealed online. If the employer is in bankruptcy, TWC cannot investigate and the claim belongs in Bankruptcy Court.
