Maine forbids requiring more than 40 hours in a week unless 1½ times the regular hourly rate is paid for every hour beyond 40, and the statute spells out that the regular rate “includes all earnings, bonuses, commissions and other compensation that is paid or due based on actual work performed.”
Minimum wage, state and local
Maine went from $7.50 in 2016 to $12.00 in 2020 and has been indexed since; the Department of Labor announced $15.70 for 2027. Portland and Rockland have their own minimum wage ordinances, and if the federal minimum ever rises above Maine’s, the state rate matches it on the same day.
Complaints and the tax answer
The Wage and Hour Division evaluates every complaint it receives but will not investigate one that does not state a potential violation within its jurisdiction. On income tax, Maine Revenue Services notes the federal tips, overtime, car-loan and senior deductions are all below the line and that “the Legislature did not choose to extend conformity to any of them.”
